Using the store

By using the site or placing an order, you agree to these Terms and the policies linked from them. You must provide accurate information, protect your account credentials and use the site only for lawful purposes. You may not interfere with the site, submit malicious code, scrape it at disruptive scale, impersonate another person or misuse payment services.

Catalog, images and availability

We aim to keep descriptions, prices and images accurate. Images may show accessories, landscaping, foundations, lighting, furniture or installation that are not included. Screen colors and natural materials can vary. Availability can change before acceptance. We may correct an obvious error, request verification, limit quantities or cancel unavailable merchandise; if payment was taken, the affected amount will be refunded.

Orders and acceptance

Your order is an offer to purchase. We accept it only after payment authorization and sending an order confirmation following any applicable availability, destination, fraud, freight and configuration checks. We may contact you when a large item requires confirmation of delivery access or included components. We will not replace an item with a materially different product without your consent.

Price, payment and tax

Prices are in U.S. dollars unless stated otherwise. Product price, known shipping charges and applicable tax are shown at checkout or in a written quote. Import costs are handled under the Shipping & Delivery Policy. Payment authorization, security and refunds are governed by the Payment & Billing Policy.

Product and project responsibilities

Before ordering, review the written dimensions, material, capacity, included-components list and intended use. The customer is responsible for site suitability, measurement, permits, HOA approval, setbacks, zoning, utilities, foundations, drainage, anchoring, safe assembly and qualified installation unless a written service agreement expressly assigns a responsibility to us.

Shipping, returns and warranty

Our Shipping & Delivery Policy, Returns, Cancellations & Refunds Policy, and Product Warranty & Consumer Guarantees Policy form part of these Terms. If there is a conflict, an item-specific written order confirmation or mandatory law controls.

Intellectual property

Wessnew Garden branding, original site copy and site design belong to or are licensed to Grayspire LLC. Third-party trademarks and authorized product assets remain the property of their respective owners. No license is granted except the limited right to use the website for shopping and support.

Service interruptions and events outside control

Site access or fulfillment may be affected by carrier disruption, customs, severe weather, disasters, strikes, government action, supply interruption or other events outside reasonable control. We will take reasonable steps to reduce the effect and will provide delay and cancellation choices required by law.

Disclaimers and liability

To the fullest extent permitted by law, the site is provided without warranties beyond those expressly stated, and we are not liable for indirect, incidental, special or consequential loss. Any aggregate claim relating to a product is limited to the amount paid for that product. These limitations do not apply to fraud, willful misconduct, personal injury caused by negligence, or any warranty, remedy or liability that cannot legally be excluded or limited.

Governing law and disputes

Colorado law governs these Terms except where mandatory consumer law in your place of residence applies. Courts with proper jurisdiction in El Paso County, Colorado may hear disputes, without limiting a consumer’s non-waivable right to use another competent court or remedy.

General terms

If one provision is unenforceable, the remaining provisions continue. A delay in enforcing a right is not a waiver. These Terms, incorporated policies and your written order confirmation form the agreement for the purchase unless both parties agree otherwise in writing.
